If you vacuum seal, sous vide, or cook-chill food in a restaurant, food truck, catering kitchen or meal prep operation, you are running what the FDA Food Code calls a specialized process. That changes your legal position completely.
Most food businesses never need a formal HACCP plan. Cook a burger, hold it hot, serve it — standard operating procedures and temperature logs are enough. But the moment you seal food in a bag and remove the oxygen, you are controlling Clostridium botulinum and Listeria monocytogenes, and a written HACCP plan stops being optional.
This guide gives you the exact decision path: when you need nothing, when you need a HACCP plan, and when you need a variance on top of it.
Quick Answer
Sous vide, cook-chill and vacuum packaging are all Reduced Oxygen Packaging (ROP) under the FDA Food Code. A food establishment that packages time/temperature control for safety (TCS) food using an ROP method must implement a HACCP plan and provide it to the regulatory authority before starting the process. There are three possible outcomes for your operation:

What actually counts as Reduced Oxygen Packaging?
ROP is the reduction of oxygen in a package below the roughly 21% found in normal air — by removing it, displacing it with another gas, or otherwise controlling it — for a food where C. botulinum or L. monocytogenes must be controlled in the final packaged form.
Five methods fall under the definition:

What is not ROP: simply storing food in a zipper-style or press-and-seal bag is generally not treated as ROP, because oxygen is not actively removed or displaced. Vacuum-style zipper systems that actively pull air out do count. If the machine has a pump, assume you are in scope.
Key fact for search and for inspectors: sous vide is not a separate legal category. It is one of five ROP methods, and the ROP rules are what govern it.
The 48-hour exemption: the rule that keeps most kitchens legal
This is the single most useful provision in the section, and most operators have never read it.
Under Food Code 3-502.12(F), a HACCP plan is not required when the establishment uses an ROP method to package TCS food that is always:
- Labeled with the production time and date, and
- Held at 41°F (5°C) or less during refrigerated storage, and
- Removed from its packaging inside the food establishment within 48 hours of packaging.
All three conditions, every time. Fail one and the exemption is gone.
What this covers in practice: vacuum-sealing tomorrow's chicken for a marinade. Portioning brisket that gets opened at service. Cooking sous vide in the morning and pulling the bag open at lunch. Same-day and next-day workflows.
What this does not cover: anything you seal on Monday and open on Thursday. Anything you build shelf life around. Anything you hand to a customer still sealed.

Route 1: ROP with a HACCP plan (no variance)
If you are past 48 hours but still inside the Code's criteria, you need a written HACCP plan submitted to your regulatory authority before implementation. The rules split depending on what you are doing.
General ROP (vacuum packaging raw or cured products)
Your HACCP plan must identify the food, and the packaged food must be held at 41°F or less and meet at least one of these four barriers:

You must also:
- Label the package on the principal display panel, in bold type on a contrasting background, with instructions to keep the food at 41°F or below and to discard it if it is not served or consumed within 30 calendar days of packaging.
- Cap refrigerated shelf life at 30 calendar days from packaging to consumption — or the original manufacturer's sell-by/use-by date, whichever comes first. Frozen time does not count against the 30 days.
- Include written operational procedures covering no bare-hand contact with ready-to-eat food, a designated work area, physical separation of raw and ready-to-eat food, access limited to trained staff, and cleaning and sanitizing of food-contact surfaces.
- Document a training program proving the person running the ROP operation understands the concepts, the equipment and the procedures.
State variation alert
Several states are stricter than the model Code. Nevada, for example, requires two barriers rather than one and caps refrigerated shelf life at 14 calendar days, not 30. Always verify against your own state code before you print a label.
Cook-chill and sous vide: eight conditions
Cook-chill and sous vide get their own subsection, and it is significantly tighter. You must submit a HACCP plan before implementation and ensure the food is:
- Prepared and consumed on the premises, or off the premises but within the same business entity — with no distribution or sale of the bagged product to another business or to a consumer.
- Cooked to the full time-and-temperature requirements for that food.
- Protected from contamination before and after cooking.
- Placed in an oxygen-barrier package and sealed before cooking, or sealed immediately after cooking and before the food drops below 135°F.
- Cooled to 41°F in the sealed package, and then held one of three ways:
- Cooled to 34°F within 48 hours of reaching 41°F, held there, and used or discarded within 30 days of packaging; or
- Held at 41°F or less for no more than seven days, then used or discarded; or
- Held frozen, with no shelf-life restriction while frozen.
- Held in a refrigeration unit equipped with an electronic system that continuously monitors time and temperature, visually examined for proper operation twice daily.
- If moved off site to a satellite location of the same business, transported with verifiable electronic monitoring devices recording time and temperature in transit.
- Labeled with the product name and the date packaged.
On top of that, cooling and cold-holding records must be maintained as part of the HACCP plan, made available to the regulator on request, and held for six months.
The requirement that stops most operators
Condition 6. A standard reach-in with a dial thermometer does not satisfy "electronic system that continuously monitors time and temperature." You need data-logging refrigeration with alarms. Budget for it before you buy the immersion circulator.
The fish rule — the one hard prohibition
You may not package fish using a reduced oxygen packaging method. The only exception is fish that is frozen before, during and after packaging, carrying a label stating it must be kept frozen until use.
There is no barrier, no plan and no workaround for fresh fish. Vacuum-sealing fresh salmon for sous vide requires a variance, full stop. This provision exists because C. botulinum type E grows at refrigeration temperatures in an anaerobic package, and fish is its natural reservoir.
Cheese
Cheese has its own narrow lane: only commercially manufactured cheeses meeting specific federal standards of identity, with no ingredients added in your establishment, a HACCP plan on file, and a use-by date no more than 30 days from packaging.
Route 2: when you need a variance
A variance is written approval from your regulatory authority to deviate from a Food Code requirement. It is a higher bar than a HACCP plan, and it is issued to your specific operation for your specific process.
You must obtain a variance before:
- Smoking food as a preservation method rather than for flavor
- Curing food
- Using additives such as vinegar to preserve food or to render it non-TCS
- ROP of TCS food except where C. botulinum and L. monocytogenes are controlled as specified in 3-502.12
- Operating a molluscan shellfish life-support display tank
- Custom processing animals for personal use
- Sprouting seeds or beans
- Any other process the regulatory authority determines requires one
For ROP specifically, item 4 is the trigger. If you want shelf life past the Code limits, want to sell the sealed package to customers, want to ROP fresh fish, or want to combine ROP with curing or preservation smoking, you are in variance territory.
A variance is not a substitute for a HACCP plan. You will submit both.
What has to be inside the HACCP plan
For ROP, the Code points to two specific parts of the HACCP plan contents. Those two are non-negotiable:
1. A flow diagram for each food or category, identifying:
- Every step in the process
- The hazards and controls at each step
- Which steps are critical control points
- The ingredients, materials and equipment used
- The recipes or formulations that carry the safety controls
2. A critical control points summary for each food or category, clearly identifying:
- Each CCP
- The critical limits for each CCP
- The method and frequency of monitoring, and who does it
- The method and frequency of verification by the person in charge
- The corrective action when a critical limit is not met
- The records kept to prove the plan is running
Health departments routinely also ask for general business information, a categorization of the TCS foods covered, a staff training plan, blank copies of every log form you intend to use, and any supporting scientific data.
The minimum CCPs for a sous vide plan
For a typical sous vide process, expect at minimum:

Your process may add more. Sealing integrity, receiving temperature and thaw control are common additions.
Why this matters at inspection
ROP requirements are classified in the Food Code as P (Priority) and Pf (Priority foundation) items — the two highest severity levels. These are not "correct by next visit" findings.
The food truck and mobile unit reality check
If you operate a mobile food unit, three practical constraints apply on top of everything above.
1. Continuous electronic monitoring on a truck is hard. Generator-powered refrigeration cycling on and off makes continuous data logging both more important and more difficult. If your reach-in cannot log temperature electronically and hold a record, you cannot meet the cook-chill and sous vide conditions on board.
2. Your commissary is usually the right place to run the process. Most operators who legitimately use sous vide run the cook and chill at the licensed commissary under an approved HACCP plan, then bring finished product to the truck. If you do that, remember the transport rule: moving ROP product to a satellite location of the same business requires verifiable electronic monitoring in transit.
3. Your health department may treat mobile units differently. Mobile plan review packets frequently state that any variance and HACCP plan must be approved before the specialized process is used by the unit — and some jurisdictions restrict specialized processes on mobile units entirely.

How rules vary by state
The FDA Food Code is a model, not federal law. It becomes enforceable only when your state or local jurisdiction adopts it — and jurisdictions adopt different editions and add their own amendments.

Why ROP HACCP plans get rejected
From published health department review checklists and guidance documents, the recurring failure points are consistent:
- No flow diagram — a narrative description of the process is not a flow diagram, and the Code names it specifically.
- Critical limits written as ranges or vague targets instead of a single measurable number with a unit.
- No corrective action stated for each CCP. "Discard product" is not a corrective action; it is one part of one.
- Monitoring frequency missing. Who checks, how, and how often, on every CCP.
- No blank log forms attached. Reviewers want to see the actual sheet your staff will fill in.
- Labeling requirements not addressed — bold type, contrasting background, principal display panel, hold temperature, discard date.
- Shelf life claimed beyond what the barrier supports, with no scientific justification attached.
- Refrigeration equipment that cannot meet the continuous monitoring requirement, with no plan to replace it.
Fixing these before submission is the difference between one review cycle and three.
Step-by-step: getting approved
Step 1 — Classify your process
Write down exactly what you seal, how long it stays sealed, and where it is opened. That determines which of the three routes you are on.
Step 2 — Test the 48-hour exemption first
If you can restructure prep so every bag is opened inside 48 hours, do that. It is legal, it is cheaper, and it is faster.
Step 3 — Contact your regulator in writing
Ask which Food Code edition they enforce, whether they require a variance for your specific process, and whether they require third-party validation. Keep the reply.
Step 4 — Verify your equipment
Confirm your refrigeration can continuously log time and temperature, and that you have a calibrated probe thermometer and a labeling system.
Step 5 — Build the plan

Step 6 — Submit and wait
The plan must be accepted before the process starts. Expect weeks, sometimes months, and expect at least one round of revisions.
Step 7 — Run the records

Outside the US
United Kingdom. Vacuum packing and sous vide are treated as higher-risk processes under FSA guidance, and businesses must operate a documented food safety management system based on HACCP principles. In both cases the underlying logic is identical to the US: anaerobic packaging plus extended refrigerated life equals a C. botulinum hazard that must be controlled in writing.
